**** VINOD S. BHARDWAJ, J. (ORAL) Challenge in the present petition is to the order dated 01.03.2024 passed by respondent No.2-Appellate Authority-cum-Addl. Chief Secretary, Industries and Commerce Department, Government of Haryana as well as to the order dated 20.06.2023 passed by respondent No.3-Director, MSME whereby the application of the petitioner company has been rejected. A further prayer has been made for directing the respondents to accept the application of the petitioner under the scheme of financial assistance for technology acquisition, as applied by the petitioner-Company on 04.07.2022 in view of the notification dated 08.06.2021. Learned State Counsel has handed over today in Court a copy of Memo No.MSME/TAS/CWP-15092/2024/4269 dated 30.09.2024, wherein it has been averred that the Administrative Secretary had earlier decided to keep the appeals on hold for clarifying the conditions mentioned in the corrigendum dated 29.11.2023 RAJENDER KUMAR 2024.10.28 08:35 I attest to the accuracy and integrity of this document
CWP-15092-2024 -2and that after filing of the present writ petition, the issue of the petitioner was also highlighted before the Administrative Secretary, Industries & Commerce, Haryana. Upon considering the same, Administrative Secretary, Industries & Commerce, Haryana has decided to review/reconsider all the appeals/applications under the present scheme, which are already decided or yet to be decided by the Administrative Secretary, Industries & Commerce, Haryana. It has thus been conveyed that the petitioner may be directed to submit his representation before the Administrative Secretary, Industries & Commerce, Haryana for reviewing/reconsidering his appeal, which shall then be decided in accordance with law by passing a speaking order. In view of the aforesaid communication, the present writ petition is allowed. The order dated 01.03.2024 passed by respondent No.2-Appellate Authority-cum-Addl. Chief Secretary, Industries and Commerce Department, Government of Haryana as well as the order dated 20.06.2023 passed by respondent No.3-Director, MSME are hereby set aside.
The petitioner is at liberty to move an appropriate application/ representation for seeking review/reconsideration of his appeal No.109 of 2023. On submission of such an application by the petitioner for seeking review/ reconsideration of his abovementioned appeal, an appropriate order shall be passed in the said appeal on merits and after granting an opportunity of hearing to the respective parties expeditiously.
