1.

The prayer in the present Civil Writ Petition filed under Articles 226/227 of the Constitution of India, is for directing the respondents to fix the pay and seniority of the petitioner w.e.f 2007 along with all consequential benefits and arrears along with 18% interest. 2.

Learned counsel would submit that pursuant to advertisement of the year 2006, the petitioner had participated in the selection process but was not appointed though in the merit list, on account of issue that had arisen regarding domicile certificate for which the petitioner preferred CWP No. 17592-2008. However, during the pendency of it, he was offered appointment letter, vide letter dated 11.09.2009. Accordingly, the petition was disposed of, vide order dated 15.12.2009. However, the pay of the petitioner was not fixed from the date i.e 17.05.2007 the other persons were selected alongside him. Now, during the pendency of the present writ petition, the speaking order has been passed on 09.03.2021, though notionally fixing his pay and regarding assigning seniority, it was stated that Gaurav Arora 2024.03.06 17:06 I attest to the accuracy and integrity of this document

CWP-18414-2020 2024:PHHC:029873  the same shall be at the appropriate time as per the merit determined by the Recruiting Agency at the time of his initial selection but till date, necessary action has not been taken. He submits on instructions of the petitioner would be satisfied, if a direction is given to the respondents to fix his seniority in a time bound manner.

Learned State counsel has no objection to the limited prayer made.

" the present writ petition is disposed of with a direction to the respondents to take a decision as regards fixation of seniority of the petitioner is concerned, within a period of 03 months from the date of the receipt of this order.
