AT CHANDIGARH CWP No.16691 of 2021 (O&M) Date of Decision: 28.10.2021 JASPAL SINGH ......Petitioner Vs STATE OF PUNJAB AND OTHERS .....Respondents CORAM: HON'BLE MR. JUSTICE RAJ MOHAN SINGH Present:Mr. Sarabjit S. Sidhu, Advocate for the petitioner.
**** RAJ MOHAN SINGH, J.(Oral) CM No.14663 of 2021 For the reasons mentioned in the application, the same is allowed. Accompanying document i.e. Annexure P-4 is taken on record, subject to all just exceptions.
Main case Petitioner has preferred this petition for the issuance of an appropriate writ, order or direction especially in the nature of mandamus directing the respondents to issue/allot and install Solar Power Pump of 3 HP capacity under P.M. KUSUM Scheme (component-B) within the prescribed period. Learned counsel for the petitioner submits that he has
not been provided with installation of solar pump under P.M. KUSUM Scheme for agricultural purposes despite making full payment. The land of the petitioner is being irrigated by canal water and the same is not sufficient to meet the standards of better irrigation. Petitioner is otherwise eligible for installation of solar pump under the aforesaid Scheme. Petitioner has already deposited the entire payment of Rs.63,520/- in the account of Punjab Energy Development Agency (PEDA). Petitioner and his family members are not having any power connection from PSPCL connection.
Precisely for the grievance in question, the petitioner has already sent a representation dated 30.07.2021 to the Joint Director, Punjab Energy Development Agency, Solar Passive Complex, Sector 33, Chandigarh/respondent No.3, but the same has not yielded any result so far.
Notice of motion.
On asking of the Court, Mr. Abhay Pal Singh Gill, Asstt. A.G., Punjab accepts notice on behalf of respondent No.1. In view of nature of order which this Court proposes to pass, there is no necessity of serving respondents No.2 and 3 or calling upon any response from them as no order prejudicial to their interests is being passed.
Since the representation dated 30.07.2021 sent by the
petitioner is pending before respondent No.3/Joint Director, Punjab Energy Development Agency, Solar Passive Complex, Sector 33, Chandigarh, therefore, this petition is disposed of with a direction to respondent No.3 to take a final view on the pending representation (Annexure P-3) and decide the same in accordance with the rules, without being influenced by any statement of fact made hereinabove within a period of one month from the date of receipt of certified copy of this order.
