The present petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (corresponding Section 482 Cr.P.C.) has been filed seeking issuance of appropriate directions to respondent No.2 for transfer of investigation to a senior officer not below the rank of Deputy Superintendent of Police (DSP), so as to ensure a fair, impartial and transparent investigation in the matter which is already sub judice before the competent Civil Court at Nihal Singh Wala and despite the petitioner being in peaceful and lawful possession of the suit land, duly protected by a subsisting stay order dated 10.06.2025, respondent No.3 is repeatedly summoning the petitioner to the police station on the basis of frivolous and anonymous complaints.

Learned counsel for the petitioner has submitted that for redressal of his grievance, the petitioner has already filed representation NEETU RANI 2026.05.11 16:41 I attest to the accuracy and authenticity of this order/judgment PHHC, CHD
CRM-M No.26421 of 2026 -2dated 28.04.2026 (Annexure P-5) before the Senior Superintendent of Police, Moga, however, no action has been taken on the same till date. 3.
Notice of motion only to the official respondents. 4.
On the asking of the Court, Mr. Sahil Chowdhary, AAG, Punjab, accepts notice on behalf of the respondent-State. 5.
Without commenting upon the merits of the case and in view of the submission made by learned counsel for the petitioner, the present petition is disposed of with a direction to respondent No.2-Senior Superintendent of Police, District Moga, to decide the representation dated 28.04.2026 (Annexure P-5) filed by the petitioner, qua threat perception in accordance with law within a period of one month from today and grant immediate protection, if any threat to the life and liberty of the petitioner, is perceived.

It is being clarified that this order shall not be taken to grant immunity to the petitioner for legal action for violation of law, if any, committed by him.
