The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking setting aside of selection of respondent No.5 for retail outlet dealership at Barnala. He is further seeking direction to respondent to consider his claim for retail outlet dealership. 2.
Mr. Ashish Kapoor, Advocate pointing out reply dated 11.08.2017 submits that respondent No.5 was issued letter of intent on 08.01.2013 and he commenced operation of petrol pump w.e.f. 29.06.2013. The said petrol pump is still in operation.

The petitioner is assailing allotment of respondent No.5 who is operating petrol pump since 2013. At this belated stage, it would not be just and fair to disturb allotment of petrol pump to respondent No.5. 4.
