Baljit Kaur v. State Of Punjab Etc
CWP 13272/2016
IN THE HIGH COURT OF PUNJAB & HARYANA
AT CHANDIGARH Date of decision:12/07/2016.
Baljit Kaur ............Petitioner vs State of Punjab and others .............Respondent CORAM:- HON'BLE MR.JUSTICE JASWANT SINGH Present:- Mr.Manish Kumar Singla,Advocate for the petitioner. Jaswant Singh,J(Oral) Petitioner is working as Social Education Panchayat Officer in the Department of Rural Development and Panchayat. She is stated to be holding the charge of BDPO since 29.12.2004.
Challenge in the present petition is to the order dated 6.7.2016 (P-7) whereby she has been transferred from Abohar to Headquarter Mohali. It is contended that since last seven months petitioner has been transferred four times and therefore, prayer is for quashing of the transfer order P-7.
A perusal of the order dated 10.12.2015 (P-4) reveals that petitioner was transferred from Headquarter Mohali to Abohar. Thereafter vide order dated 31.5.2016(P-5) she was transferred from Abohar to Morinda. The order P-5 was cancelled vide subsequent order dated 7.6.2016 (P-6). Thus, after transfer from Headquarter to Abohar in December 2015 she has been transferred back to Mohali. On a pointed query, it is also not disputed that prior to her transfer from Headquarter Mohali to Abohar in December 2015 the petitioner had remained posted only for three months. Facts taken cumulatively, no case for interference in present writ petition under Articles 226/227 of the Constitution is made out. Dismissed.
