(Oral) Petitioners have approached this Court for the issuance of a writ, order or direction especially in the nature of mandamus directing the respondents to make payment of Form D.F.R (PW) Running Account Bill C (Annexures P-4 to P-6) to the petitioners in respect of work completed by the petitioner in pursuance of tender.

Learned counsel for the petitioners submits that petitioner-Company is a Government Contractor. PetitionerCompany was allocated work of annual repair, special repair of Judges residence no.2, 3 & 4 at Malerkotla in pursuance of the tender dated 30.07.2018. Petitioners have already completed the work assigned. Bills have been sanctioned, but the payments thereafter have not been released to the petitioners despite number of representations including a legal notice dated MOHMED ATIK 2022.07.25 16:31 I attest to the accuracy and authenticity of this order/judgment

Learned counsel for the petitioners submits that at this stage, the petitioners would be satisfied in case its legal notice dated 27.04.2022 is directed to be decided by respondent No.4 by passing a speaking order in accordance with law at the earliest.

Notice of motion.

On the asking of the Court, Ms. Akanksha, Asstt. A.G., Punjab accepts notice on behalf of the respondents. This writ petition is disposed of with a direction to respondent No.4 to consider the pending legal notice dated 27.04.2022 got issued by the petitioners and pass appropriate order in accordance with law, preferably within a period of one month from the date of receipt of certified copy of this order. If the claim of the petitioners is established with reference to record, then the payment be released to the petitioners forthwith.

If the claim of the petitioners is found to be not sustainable, then a copy of decision be supplied to the petitioners at the earliest.
