The present writ petition has been filed under Articles 226/227 of the Constitution of India for issuance of a writ in the nature of mandamus directing the respondents to consider the petitioner's claim that she is eligible for the post of clerk in General Category. Learned counsel for the petitioner has contended that the only criteria for appointment to the post of Clerk is on the basis of a written examination. It is further contended that the petitioner has secured 65 marks in the written examination and 5 marks are to be given to her as per her socio-economic criteria and, accordingly, she would have secured 70 marks which is more than the marks secured by the last selected candidate. Learned counsel for the petitioner has also relied upon the order passed by this Court in CWP No.14204 of 2020 titled as Pooja vs. Haryana Staff Selection Commission, decided on 11.09.2020. I have heard the learned counsel for the parties. Learned counsel for both the parties are ad idem that the present writ petition may also be disposed off with a direction to the respondent to treat the present writ petition along with its annexures as a representation on behalf of the petitioner and to decide the same within a period of one month by passing a speaking order in accordance with law. In view of the above, the present writ petition is disposed off with a direction to the respondent to consider the claim of the petitioner by treating the present writ petition along with its annexures as a representation on behalf of the petitioner and decide the same within a period of one month from today by passing a speaking order in accordance with law.
