IN THE HIGH COURT OF PUNJAB AND HARYANA AT

CHANDIGARH CRM-M-35432-2021 Date of decision: - 31.08.2021 Manjeet Kaur and another ....Petitioners

Versus

State of Haryana and others .....Respondents CORAM : HON'BLE MR. JUSTICE HARSIMRAN SINGH SETHI Present:- Mr. Kamal Kant, Advocate, for the petitioner. Mr. Gaurav Bansal, Assistant Advocate General, Haryana. (keeping in view of the advance copy given).

( Through Video Conferencing ) **** HARSIMRAN SINGH SETHI , J. (ORAL) Present petition has been filed under Section 482 Cr.P.C. for issuance of appropriate order or direction to respondents No.1 to 3 for completing the investigation in FIR No.362 dated 04.05.2021, registered under Sections 148, 149, 323, 324 and 506 IPC, at Police Station Karnal Sadar, District Karnal.

Learned counsel for the petitioners submits that no investigation has taken place in respect of the above-said FIR and the petitioners are being aggrieved/prejudiced against non-conducting of proper investigation by the authorities.

Notice of motion.

Mr. Gaurav Bansal, Assistant Advocate General, Haryana, NARESH KUMAR 2021.09.01 16:18 I attest to the accuracy and integrity of this document

CRM-M-35432-2021 -2who has joined the proceedings through video conference, keeping in view the service of advance copy of petition accepts notice on behalf of respondents-State.

Learned State counsel submits that there is already an FIR No.288 dated 14.04.2021, which is also registered against the petitioners under Sections 148, 149, 323, 324, 447, 506 and 511 IPC and the police is conducting the investigation in a proper manner as earlier the accused were on run in both the FIRs and now after grant of the anticipatory bail, they have joined the investigation and investigation will be completed as expeditiously as possible.

Learned counsel for the petitioners has not been able to show that the grievance, which is being raised by the petitioners in the present petition, has ever been raised before the authorities concerned. In case the petitioners had any grievance regarding non-conducting of investigation, they would have first approached the higher authorities in the police. Learned counsel for the petitioners fairly concedes that there is no representation which the petitioners had filed before the authorities raising the grievance as raised in the present petition. Keeping in view the facts and circumstance mentioned above, no ground is made out, at this stage, to give any direction as being prayed by the petitioners in the present petition. Dismissed.
