DEEPAK GUPTA , J.(Oral) Prayer in this petition filed under Section 439 Cr.P.C. is for grant of regular bail in case FIR No.27, dated 19.03.2023, under Sections 279, 188, 212, 216, 109 and 120-B of IPC, besides Section 25 of the Arms Act, 1959, registered at Police Station Mehatpur, District Jalandhar. The only role attributed to the petitioner is to have provided shelter and to have helped the co-accused in fleeing and running away from the police.
Learned State counsel concedes that the said role of the petitioner attracts at the most Section 216 IPC, which is a bailable offence.
Having regard to the aforesaid facts and circumstances, but without commenting anything upon the merits of the case, petitioner is admitted to bail. She is ordered to be released on bail on her furnishing requisite bail bonds and surety bonds to the satisfaction of learned Chief Judicial Magistrate/Duty Magistrate concerned. Allowed.
