Petitioners have filed this writ petition seeking compensation for alleged custodial torture they were subject to at the hands of respondent no. 2. It appears an incident took place on 31.12.1997. It was alleged that petitioners created a ruckus and entered into 'no vehicle' zone. They also beat up certain police officials. FIR no. 1 dated 01.01.1998 was registered at Police Station Civil Lines, Amritsar. Investigation ensued. Challan was filed before the competent court. Petitioners also filed a complaint levelling counter allegations. Judicial Magistrate Ist Class, Amritsar acquitted the petitioners of the charges levelled against them. However, complaint preferred by petitioners was accepted and respondents no. 2 to 4 were convicted. Appeals were filed against both the orders passed by JMIC, Amritsar i.e. in challan case as well as the complaint case. CWP No. 14977 of 2014 up before Additional Sessions Judge, Amritsar. The court has been apprised today that both the appeals have been accepted by the Additional Sessions Judge, Amritsar. An order dated 19.04.2017 has been passed wherein respondents no. 2 to 4 have been acquitted in the complaint case. On the other hand, petitioners have been convicted and sentenced accordingly. Short affidavit of respondent no. 3 has also been filed which is taken on record.

In view of above, present petition has been rendered infructuous and is dismissed as such.
