(Oral) Learned counsel for the petitioner submits that on the one hand, statutory appeal as well as stay application of the petitioner are not being considered by the appellate authority, i.e. Secretary, Rural Development Panchayat, Punjab-respondent No.1 and on the other hand, petitioner is being pressed hard to hand over the charge of Sarpanch. He further submits that if the petitioner hands over the charge, her appeal as well as stay application would become infructuous.

Notice of the motion.

On the asking of the Court, Mr. Yatinder Sharma, Additional A.G. Punjab, accepts notice on behalf of the respondents. After hearing learned counsel for the parties, instant writ petition is disposed of with a direction to the appellate authority, i.e. Secretary, Rural Development Panchayat Punjab-respondent No.1, to decide the appeal AMIT KUMAR 2016.07.13 12:50 I attest to the accuracy and authenticity of this document

CWP No. 13331 of 2016 (O&M) of the petitioner at an early date by passing an appropriate order, in accordance with law, and preferably on the date already fixed for hearing, i.e. 10.8.2016. However, till the stay application of the petitioner is considered and decided by respondent No.1, her suspension order shall remain stayed.
