(Oral) In the present writ petition, the petitioner seeks quashing of the proceedings dated 23.05.2012 (Annexure P-1/T) of the Department Promotion Committee whereby, his claim for promotion has been rejected and respondent no. 3 has been promoted as Superintendent (Grade I) vide order dated 21.06.2012 (Annexure P-6/T).
Counsel for the petitioner submits that the name of the petitioner was included for consideration but he was not given the benefit of various bench marks by ignoring relevant instructions on the issue and if his Annual Confidential Report for the year 2011-12 was taken into consideration, he would have attained the necessary bench marks. Admittedly, the petitioner has represented for his grievances by sending a legal notice dated 22.07.2014 (Annexure P-9). No action has been taken on the said legal notice by the respondents.
Accordingly, at this stage, without commenting on the merits of the case and keeping in view the fact that the petitioner has filed representation by way of legal notice, this Court is of the opinion that it SHIVANI GUPTA 2015.08.18 14:51 I attest to the accuracy and integrity of this document Chandigarh
-2would be appropriate if respondent no. 2 takes a decision on the said legal notice after taking into consideration the submissions made therein.
