Archana Yadav And ANR v. State Of Punjab And Others
IN THE HIGH COURT OF PUNJAB AND HARYANA
AT CHANDIGARH CRWP No.8193 of 2021 Date of Decision:27.08.2021 ARCHANA YADAV AND ANR ......Petitioners Vs STATE OF PUNJAB AND ORS .....Respondents CORAM: HON'BLE MR. JUSTICE RAJ MOHAN SINGH Present:Mr. Krishan Kanha, Advocate for the petitioners.
**** RAJ MOHAN SINGH, J.(Oral) The case has been taken up for hearing through video conferencing.
Learned counsel for the petitioners submits that petitioners are matured. Marriage was solemnized on 24.08.2021 but a day earlier to the marriage they filed a representation dated 23.08.2021 before the SSP, Barnala. Petitioners have prayed for issuance of necessary directions to the official respondents for protecting their civil/personal rights and liberties from being invaded by the private respondents. Petitioners are alleged to have solemnized
marriage on 24.08.2021 on attaining the age of majority. They feel reasonable apprehension and threat perception at the hands of the private respondents and pray that their personal/civil rights be not violated by them. Precisely, in the context of aforesaid relief, petitioners have approached the Senior Superintendent of Police, Barnala & SHO, Police Station Barnala, District Barnala/respondents No.2 & 3 by way of representation dated 23.08.2021 (through courier).
Notice of motion to respondents No.1 to 3.
On the asking of the Court, Mr. Bupender Beniwal, Punjab accepts notice on behalf of State-respondents No.1 to 3. At this stage, without meaning anything in the context of validity of marriage and majority of the petitioners, it would be just and appropriate to direct respondent No.2 to look into the grievance of the petitioners and pass an appropriate order on merits in accordance with law. Respondent No.2 would pass necessary order without being influenced by any pleadings made in the petition.
This order shall not debar the official respondents from proceeding against any of the parties, if they are involved in any other case. It would be appreciated if the needful is done within a period of one month from the date of receipt of certified copy
of this order.
Petition stands disposed of accordingly.
