**** Rajan Gupta, J. (Oral) Petitioner has sought a direction to allow the petitioner-Mill to deliver the 193 metric tonnes of rice to FCI. At the outset, learned counsel appearing for respondents No.4 to 6, points out that while filing this petition, petitioner had relied upon the fact that notice of motion had been issue in another case i.e. CWP-13880-2015. According to him, same was dismissed as withdrawn vide order dated 03.08.2016 passed by co-ordinate Bench ( Rakesh Kumar Jain, J). Admittedly, arbitration proceedings have already culminated and petitioner has availed remedy of appeal before the appellate court. Appeal is stated to be pending at present. Thus, this court finds no ground to interfere in writ jurisdiction. Even otherwise, prayer made in the petition is innocuous. Same is hereby dismissed.
