The present petition has been filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short-'BNSS') for directing respondents No. 2 to 5 not to dispossess the petitioners from their land on the instance of private respondents as respondent No. 5 is trying to vacate the possession of the petitioners from the land in their possession to hand over the same to the private respondents with a further prayer to direct the respondents No. 2 to 5 to rpotect the life and liberty of the petitioners.

Learned counsel for the petitioner submits that the petitioner's land is under dispute with the private respondents and a civil suit in regard is pending between the parties. He further alleges that the local police is unnecessarily interfering in his peaceful possession and also registered a false case against him. 3.
Learned State counsel, on the other hand, has filed a status report by way of an affidavit of Sh. Vikas Arora, IPS, Commissioner of Police, Gurugram, wherein it has been stated that the deponent undertakes that no party shall be forcibly dispossessed from the disputed land without there being a specific direction issued by a Court of competent jurisdiction to the police. 4.
