$$(* '&$$   +&, -./   [1] The present Criminal Writ Petition has been filed under Article 226 of the Constitution of India for issuance of a writ order or directing the respondents authorities to initiate and considered the case of the petitioner for premature release in terms of policy dated 04.04.2013 (Annexure P-2).

[2] Counsel for the petitioner submits that the petitioner has applied for premature release as a convict in terms of the policy dated 04.04.2013 (Annexure P-2). Respondents are not taking any action. That the petitioner issued the legal notice dated 12.04.2025 (Annexure P-5). It is contended that the Coordinate Bench vide order dated 27.09.2024 (Annexure P-3) has interpreted the said policy and the objection raised by the State was refuted that parole period cannot be counted and Priyanka Thakur 2025.05.23 18:29 I attest to the accuracy and integrity of this document

The Coordinate Bench directed the State counsel to consider the parole period while counting the actual sentence of the petitioner in terms of the observations given in Para 21 of the order having case No.CRWP-796-2024 dated 27.09.2024 titled as Rupinder Singh Vs. [5] Keeping in view the innocuous prayer made, seeking written reply from the respondents is dispensed with. [6] In view of the above, the present petition is disposed of with the direction to the State to consider and decide the representation given by way of legal notice dated 12.04.2025 (Annexure P-5) within a period of two months from the date of the receipt of the certified copy of this order in terms of the policy dated 04.04.2013(Annexure P-2) and in terms of the decision of Co-ordinate Bench of this Court dated 27.09.2024 (Annexure P-3).
