**** ANITA CHAUDHRY, J This revision challenges the judgment dated 2.2.2018 vide which the Additional Sessions Judge, Patiala has upheld the order passed by Principal Magistrate, Juvenile Justice Board, Patiala rejecting the regular bail plea of the petitioner.
The allegations against the petitioner are that he committed unnatural offence with his cousin who is 14 years old while the family was away. The incident had taken place on 12.12.2017 and the matter was reported on 15.12.2017. The petitioner is confined in Observation Home. Counsel for the petitioner contends that petitioner is also a student and his exams are approaching and he lives in a separate house and challan has already been presented and bail be allowed. State counsel was asked to verify whether the complainant and the accused were living in the same house.

Investigation is over and challan has been presented. The petitioner is a student and his examination will be starting shortly. Considering the entire conspectus, the petition is allowed and the petitioner is ordered to be released on bail on his furnishing local surety and adequate bonds to the satisfaction of the trial Court/Duty Magistrate with the condition that he would not contact the victim or his family or tamper with evidence.
