M.M.S. BEDI, J. (ORAL) Petitioner, through the instant petition under Article 226 of the Constitution of India, seeks a direction to the respondents to consider his prayer for release on agricultural parole in order to enable him to execute necessary agricultural work and plough his fields. The petitioner claims that he had submitted an application to that effect on 20.6.2017 but despite expiry of two months, no final decision has been taken on the same. CRWP-943-2017 When asked to produce copy of the application dated 20.6.2017, counsel for the petitioner informs that in Jail there is no facility for the inmates to keep a copy of the application submitted. Notice of motion to the respondents.
On asking of the Court, notice has been accepted by Ms.Shubhra Singh, Addl. A.G. Haryana, present in the Court on behalf of all the respondents.
Without expression of any opinion on merits of the claim of the petitioner, in the interest of justice, this petition is disposed of, at this stage, with a direction to respondent No.3, the Superintendent of Jail, Jhajjar, to intimate the petitioner in writing the result of the application dated 20.6.2017 submitted by him. In case the said application has not been processed till date, necessary steps to process the same will be taken within a period of one week. It is further made clear that in case no such application has been received by the Superintendent of Jail, Jhajjar, the petitioner will be at liberty to file a fresh petition within a period of 10 days after the receipt of information by him regarding processing of the application dated 20.6.2017 alleged to have been submitted by him. In case the petitioner files a fresh petition, the same may be processed, in accordance with law, expeditiously.
