RAMESHWAR SINGH MALIK, J Feeling aggrieved against the alleged inaction on the part of respondent authorities and particularly respondent no.4, petitioner has approached this court, by way of instant petition, under Articles 226/227 of the Constitution of India, seeking a writ in the nature of mandamus directing the respondent authorities to execute the conveyance deed in favour of the petitioner, as per the entitlement of the petitioner. Learned counsel for the petitioner submits that the share of the petitioner in the respondent-Cooperative Society, is not in dispute. Allotment has already been made and possession has also been delivered. However, the conveyance deed is not being executed in favour of the petitioner. CWP No.13514 of 2016 redressed, he approached respondent no.4 by way of representation dated 22.9.2015 (Annexure P-5), but the same is also pending decision. Learned counsel for the petitioner further submits that the petitioner will be satisfied, in case respondent no.4 is directed to decide the representation of the petitioner within a reasonable time, by passing an appropriate order, in accordance with law.

Having heard the learned counsel for the petitioner and without expressing any opinion on the merits of the case, including the issue of limitation, if any, the Saraswati Kunj Cooperative House Building Society Limited, Wazirabad, Gurgaon through its Board of Administratorsrespondent no.4 is directed to consider the grievance of the petitioner, which prima facie seems to be genuine and decide the representation dated 22.9.2015 (Annexure P-5), by passing an appropriate order thereon, in accordance with law, within a period of three months from the date of receipt of a certified copy of this order.

With the observations made above, the present writ petition stands disposed of.
