Mr. Nakul Sharma, Advocate, for the petitioners. RAJESH BINDAL, J Challenge in the present petition is to the notification dated 1.7.2016, whereby bye election to the post of Sarpanch of Gram Panchayat, Bishanpura has been scheduled.

The stand of the petitioners is that in the meeting held on 25.7.2015, petitioner No.1 was elected as authorised Panch on account of vacancy created by removal of Dalip Singh from the post of Sarpanch. Once, development activities in the village are going on smoothly, petitioner No.1 should be allowed to continue as such. After hearing learned counsel for the petitioners, we do not find any merit in the present petition.

The Gram Panchayat made a temporary arrangement while permitting petitioner No. 1 to work as authorised Panch in the absence of regular Sarpanch. Even if, any development activities are going on smoothly, which are being taken care of either by petitioner No.1 as authorised Panch or the other Panches, the same does not mean that election for the post of Sarpanch should not be held, which is statutory in nature. The petition stands dismissed.
