At the very outset, learned counsel for the petitioner has filed an affidavit of petitioner-Inderpal Singh and the same is taken on record. Para No. 2 of the affidavit reads as under:- (2) That after filing of the suit and the orders passed on interim application by the Courts below and then after filing the above mentioned revision petition, on reconsideration and as advised, the petitioner feels that the suit as filed by him is not maintainable in view of the pendency of the earlier suit with regard to the same property before the Civil Court at Gurugram and therefore the deponent craves indulgence of this Hon'ble Court that the above mentioned revision petition and also Civil Suit No. 1907 of 2019 titled as Inderpal Singh vs. M.C.G pending in the Court of Civil Judge (Jr. Divn.)

Gurugram may also be allowed to be withdrawn without prejudice to his rights in the suit pending against the Gram Panchayat now Municipal Corporation, Gurgaon." In view of the affidavit filed by the petitioner, the present petition stands disposed of and the present revision petition and also Civil Suit No. 1907 of 2019 titled as Inderpal Singh vs. M.C.G pending in the Court of Civil Judge (Jr. Divn.)
