CWP-14499-2015 (O&M) 2023:PHHC:144418
IN THE HIGH COURT OF PUNJAB AND HARYANA AT
CHANDIGARH CWP-14499-2015 (O&M) Decided on : 14.11.2023 Anil Asija . . .Petitioner
Versus
State Of Haryana And Others . . . Respondents
CORAM:
HON'BLE MR. JUSTICE HARSIMRAN SINGH SETHI PRESENT: Mr. Ashutosh Kaushik, Advocate for the petitioner. Mr. Saurabh Mohunta, DAG, Haryana.
Mr. Abhishek Bansal, Advocate for Mr. Ravinder Malik (Ravi), Advocate for respondent No. 4.
Mr. Jasbir Mor, Advocate for respondents No. 5 & 7.
Mrs. Kiran Bala Jain, Advocate for respondent No. 6.
**** HARSIMRAN SINGH SETHI , J. (Oral) 1.
In the present petition, the grievance of the petitioner is that the selection of the private respondents on the post of Assistant Public Relation Officer is contrary to the terms and conditions of the advertisement as well as the experience certificates submitted by the private respondents have not been verified by the department concerned before extending the appointment to the private respondents. 2.
Learned counsel for the State submits that the selection for the post in question was done by another agency hence, the eligibility was to be seen by the selecting agency and the private respondents have already been appointed by the department concerned after their names were recommended.
3.
The selecting agency on the other hand submits that they have selected the candidates on the basis of the information supplied by them and the verification of the said information is to be done by the RIYA 2023.11.16 10:58 I attest to the accuracy and integrity of this document
CWP-14499-2015 (O&M) 2023:PHHC:144418 department before giving the employment to the selected candidates. 4.
From the perusal of the above fact which shows that neither the selecting agency nor the appointing authority has gone through the relevant documents submitted by the selected candidates as to whether, the selected candidates fulfilled the eligibility criteria as per the advertisement or whether, the documents submitted by the selected candidates were genuine so as to allow them to have an appointment to the post in question.
5.
Faced with the situation, the learned counsel for the respondents submits that appropriate procedure will be undertaken so as to verify the genuinity of the documents submitted by the selected candidates and also the fact that whether they have fulfilled the required qualification/conditions as per the advertisement or not and thereafter, an appropriate order will be passed within a period of three months from the date of receipt of the copy of this order. 6.
It may be noticed that as the private respondents are already in service and have rendered approximately eight years of service, while ascertaining the facts, the private respondents be given opportunity to defend themselves qua their eligibility for the post concerned as well as the genuinity of the documents submitted by them. 7.
Petition is disposed off with above mentioned observations. (HARSIMRAN SINGH SETHI) JUDGE 14.11.2023 Riya Whether speaking/reasoned:
