Petitioner has filed this petition under Section 439 read with Section 482 Cr.P.C. for grant of regular bail in case FIR No.124 dated 08.08.2004 under Section 15 of the NDPS Act (Sections 473 and 467 IPC added later on), registered at Police Station Bhikhi, District Mansa. Notice of motion was issued. Learned State counsel appeared and contested the petition.
I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. As per learned counsel for the petitioner, the recovery in the present case is of 352 kgs. of poppy husk. Learned counsel for the petitioner contended that the petitioner was already on regular bail and he VINEET GULATI 2019.07.26 12:15 I attest to the accuracy and authenticity of this document Chandigarh
CRM No.M-27914 of 2019 -2absented from the Court proceedings. He further contended that the trial of the case will take long time and no purpose will be served by keeping the petitioner in custody.
The perusal of the record shows that FIR is of 2004. The petitioner absented from the Court proceedings on 26.11.2007 and he was arrested after about ten years i.e. on 25.09.2017. The petitioner has already been declared Proclaimed Offender. If the petitioner is released on bail, there is every chance that he may again abscond from the proceedings. Keeping in view the facts and circumstances of the present case, I do not find it a fit case where petitioner is entitled to benefit of regular bail.
Therefore, finding no merit in the present petition, the same is dismissed.
