CRM-M No.27568 of 2018 This is a petition that has been filed for grant of regular bail in case FIR No.30 dated 27.11.2018 under Sections 363, 366-A, 120-B IPC and Section 376 added later on, registered at Police Station Narot Jaimal, District Pathankot.
Counsel for the petitioner herein would contend that initially the petitioner had been arrested and released on regular bail but subsequent to adding of Section 376 IPC, she was again arrested on 3.6.2019. It is argued that allegation of Section 376 IPC at best would be applicable to one Bhola Singh.

CRM-M No.27586 of 2019 -2regular bail, who argues that no ground is made out for concession of regular bail.
I have heard learned counsel for the parties and taking into consideration that the petitioner herein had been allowed regular bail by the Court on an earlier occasion and allegation of Section 376 IPC would not be applicable to her, as it would be made out against one Bhola Singh, who is absconding and since the trial is likely to take some time to conclude, no useful purpose would be served in keeping the petitioner behind the bars. The instant petition is allowed and the petitioner is directed to be released on regular bail on execution of adequate personal bond and surety bond to the satisfaction of concerned trial Court/Duty Magistrate. However, any observation made herein shall not construed to be an expression on merits of the case.
