*** DEEPAK GUPTA, J. (ORAL) On 13.06.2023, following order was passed:- Prayer in the present petition filed under Section 438 Cr.P.C. is for grant of anticipatory bail to the petitioner in case bearing FIR No.64, dated 10.04.2023, under Sections 307, 323, 341, 148, 149 of IPC, 1860 and Section 25 of Arms Act, 1959, registered at Police Station Beas, District Amritsar. It is contended by learned counsel for the petitioner that no specific role or injury is attributed to the petitioner in this case. It is further contended by learned counsel that the only allegation against the petitioner is that he had accompanied the other co-accused. It is Vicky, Gopi Butari and Manu Padda, who have been attributed injuries to the complainant, namely, Akashdeep Singh.

Learned counsel for the petitioner further contends that similarly placed co-accused, Raja has already been granted the benefit of interim bail by

this Court vide order dated 02.06.2023 passed in CRM-M No.29053 of 2023 (Annexure P-7).

Notice of motion.

At the asking of the Court, Mr. Navneet Singh, Sr. DAG, Punjab appears and accepts notice on behalf of the respondent-State.

The factual position as disclosed by learned counsel for the petitioner, is not disputed by learned State counsel. List on 08.08.2023.

In the meantime, petitioner is directed to join investigation and co-operate in the same. He will not leave the country without prior permission of the Court nor shall make any attempt to contact the complainant of the case or any witness associated with the case. In the event of the arrest of the petitioner, he shall be released on interim bail on his furnishing personal/surety bonds to the satisfaction of the Arresting Officer/Investigating Officer. He shall also abide by conditions as envisaged under Section 438(2) Cr.P.C.

To be heard along with CRM-M No.29053 of 2023. "

Short reply by way of an affidavit of Sukhwinder Pal Singh, PPS, Deputy Superintendent of Police, Sub-Division Baba Bakala Sahib, Amritsar (Rural) has been filed. The same is taken on record. Today, though a written request for an adjournment has been received on behalf of learned counsel for the petitioner, but statement is made by learned State counsel on instructions from ASI Gurmeet Singh, that the petitioner has joined the investigation, in compliance of the order dated 13.06.2023 and is no longer required for further investigation. The said fact is also reflected in the short reply filed today. In view of the aforesaid, the order dated 13.06.2023, whereby the petitioner was granted interim anticipatory bail, is hereby made absolute.

However, he shall continue to join investigation, if and so required by the Investigating Officer.
