******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 438 Code of Criminal Procedure for grant of anticipatory bail to the petitioner in case FIR No.4 dated 06.01.2019 registered for the offence punishable under Section 61 (1) of the Punjab Excise Act, 1914, at Police Station Block Majri, District SAS Nagar.

Heard.

As per case of prosecution, 200 boxes of liquor were recovered from Mahindra Pick-up bearing registration no. PB-10-BX-3633. Learned State counsel on instructions from ASI Parminder Singh submits that on investigation it has come to notice that the aforesaid vehicle was earlier owned by Ravinder Singh, who had sold it to Dalbir Singh. Statement of Dalbir Singh was also recorded, who has stated that the petitioner was employed as driver by him and he was operating the vehicle. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. He is not driver of Dalbir Singh. CRM-M-27646 of 2019 -2Liquor recovered in this case was for sale in Chandigarh and was recovered in Mohali. In view of the evidence that has been collected by the police, this case calls for thorough investigation to look into smuggling of liquor in State of Punjab to cause loss to exchequer. Custodial interrogation of the petitioner is required by the police to unearth the racket. This petition has no merit and the same is dismissed.
