(Oral) The grievance of the petitioner in the present writ petition is that owing to formation of new Gram Panchayat namely Gram Panchayat Jhugge Kishore Singh Wala, out of Gram Panchayat Chalk Bange Wala, District Ferozepur, certain things, i.e., land, stores, assets, articles, grants etc. which have fallen to the share of newly constituted Panchayat, is violative as per the provisions of Section 3 (2 and 3) of the Punjab Panchayati Raj Act, 1994.

In my view, grievance of the petitioner can not be vindicated in the petition filed under Section 226 of the Constitution of India. He has to approach the Director or Secretary, Rural Development and Panchayat, Panchayat by moving an appropriate application. At this stage, Mr. Duggall, Advocate submits that his writ petition may be treated as application to be filed before the Director, Rural Development and Panchayat, Panchayat, for vindication of the grievance. CWP No.10126 of 2017 {2} In view of the aforementioned, I deem it appropriate to dispose of the writ petition by treating it as application contemplated to be filed before the Director, Rural Development and Panchayat, Panchayat, who shall decide the same in accordance with law and deal with the grievances raised in the present writ petition.
