Jaswant Singh,J(Oral) Petitioner was working as work charged T-Mate w.e.f. 1.2.1984 and his services were terminated on 25.7.1990 on the ground that he had secured job on the basis of a fake certificate. The Labour Court decided the reference in favour of the petitioner/workman and ordered reinstatement with 50% back wages, while the writ petition filed by the employer i.e. erstwhile Punjab State Electricity Board was dismissed by this Court and in the SLP the award of the Labour Court was modified to the extent that entire back wages were denied while upholding the relief of reinstatement with continuity of service.

In terms of the permission granted in the award for completion of the proceedings qua the alleged fake certificate CWP No.618/2010 was filed by the petitioner/workman wherein vide interim order dated 5.8.2011 conclusion of the proceedings was stayed while "Admitting" the writ petition. The petitioner was, in the inter regnum, reinstated on 24.8.2005 and stands retired on attaining the age of superannuation w.e.f. 31.12.2015. By filing present writ petition he is seeking consideration of regularization of his services in terms of the policy.
