IN THE HIGH COURT OF PUNJAB AND HARYANA

AT CHANDIGARH CWP No.10194 of 2017 Date of Decision: 27.07.2022 SACHIN AND ORS.

......Petitioners Vs STATE OF HARYANA AND ORS.

.....Respondents CORAM: HON'BLE MR. JUSTICE RAJ MOHAN SINGH Present:Mr. S.S. Hooda, Advocate for the petitioners.

Mr. Vivek Chauhan, Addl. A.G., Haryana.

**** RAJ MOHAN SINGH, J.(Oral) Petitioners have preferred this writ petition for the issuance of an appropriate writ order or direction in the nature of certiorari for quashing the order dated 26.04.2016 passed by State Public Information Officer-cum- Distt. Sports and Youth Affairs Officer, Rohtak and order dated 13.05.2016 passed by the Distt. Sports and Youth Affairs Officer, Rohtak. Letter dated 26.04.2016 is addressed to petitioner No.1 whereas letter dated 13.05.2016 is addressed to petitioner No.2.

Notice of motion was issued on 12.05.2017. Respondents No.1 to 3 have filed the written statement. Para

No.3 of the preliminary objection reads as under:- "3.

That the department of Sports & Youth Affairs Haryana, on 14.11.2017 constituted a committee for verification of the eligibility of the petitioners for cash award. The above committee on 16.11.2017 had checked the documents submitted by the petitioners and found that petitioner Sachin is eligible on the basis of his achievement of 25th National Inter Zonal Athletics Championship and 29th National Junior Athletics Championship and his case for granting cash prize is under process. It is further submitted that the claims of petitioner No.2 to 5 do not cover under the Sports Policy-2009. Therefore, they are not entitled for any cash prize from the answering department."

Evidently, the case of petitioner No.1 was processed on the basis of his eligibility as he had participated in the 25th National Inter Zonal Athletics Championship and 29th National Junior Athletics Championship. On the basis of his achievement, petitioner No.1's case was processed for grant of cash award. The claims of petitioners No.2 to 5 were rejected as their events were not included in the Sports Policy-2009 for which cash awards/prize were to be paid.

On 02.03.2022, learned State counsel with reference to the State Policy of 2009 submitted that petitioner No.1 has already been paid an amount of Rs.2 lakhs on 05.05.2018

owing to his participation in National Championship i.e. 25th National Inter Zonal Athletics Championship and 29th National Junior Athletics Championship. Petitioners No.2 to 5 had only participated in National Junior Athletics Championship and said Championship is not covered under Annexure-II attached with the Policy.

Learned counsel for the petitioners could not dispute the aforesaid facts with reference to any document on record. In view of stand taken by the respondents, this writ petition is rendered infructuous qua petitioner No.1 as the needful in the context of payment of cash prize has already been done and qua petitioners No.2 to 5, this writ petition is dismissed.
