M.M.S. BEDI, J. (ORAL) Petitioner is elected Councillor of Ward No.6, Municipal Committee, Nuh. He claims that there are many trees planted in the area of Municipal Committee, Nuh, which had been cut on 24.11.2016 by the President as well as the Secretary of the Municipal Committee which is in violation of the Environment Laws.
In this context, the petitioner has submitted a representation to the Forest Officer, Forest Department, Nuh, Annexure P5 dated 25.11.2016.
Through the instant petition, the petitioner seeks a direction to the Forest Officer to take legal action against the President and Raj Kumar Arora 2017.05.22 11:20 I attest to the accuracy and integrity of this document
CWP-10223-2017 (O&M) the Secretary of the Municipal Committee as well as the staff members. I have considered the contentions of the counsel for the petitioner and I am of the opinion that on account of inter se differences of the members/ Councillors of Municipal Committee, the tool of Article 226 of the Constitution of India, cannot be used to settle the personal scores. No ground is made out for issuing any directions. The petition is dismissed. However, it will be open to the petitioner to avail any other legal remedy by approaching the appropriate forum, in accordance with law.
