The instant petition has been filed on behalf of the petitioner seeking grant of anticipatory bail in respect of aforementioned FIR.

At the time of issuance of interim bail the following order was passed on 06.06.2024:

"Learned counsel for the petitioner inter alia contends that the petitioner has been falsely implicated in this case on account of political rivalry in the village; the petitioner alongwith other villagers had lodged complaints against the complainant with regard to illegal mining and in retaliation the complainant has lodged the FIR in question against the petitioner; no trees have been recovered from the petitioner; the petitioner does not have any other criminal antecedents and that he is also ready and willing to join and cooperate with the investigation. Notice of motion.

Mr.Rohit Bansal, Sr.DAG, Punjab, accepts notice on behalf of the respondent and prays for time to argue the matter. Adjourned to 27.08.2024.

In the meanwhile subject to the petitioner's joining investigation as and when called by the investigating agency as also abiding by the other conditions provided under Section 438(2) Cr.P.C, in the event of his arrest in FIR No.0023 dated 28.03.2024 registered under Section 379 IPC at Police Station Chamkaur Sahib, District Rupnagar, he shall be released on ad interim anticipatory bail to the satisfaction of the Arresting Officer."

Learned State counsel has submitted that the petitioner has joined investigation and is not required for any custodial interrogation. 4.

In view of the aforestated position wherein the petitioner has joined investigation and he is not stated to be required for any custodial interrogation, the petition is accepted and the interim directions issued

- 3 - by this Court vide order dated 06.06.2024 are hereby made absolute subject to the condition that the petitioner shall join investigation as and when called upon to do so and cooperate with the Investigating Officer and shall also abide by the conditions as provided under Section 438 (2) Cr.P.C.
