ALKA SARIN, J.: (Oral) Heard through video conferencing.

The present Criminal Writ Petition has been filed under Article 226 of the Constitution of India for directing the official respondents No.2 and 3 to give police protection to the petitioner and also issue a direction to respondent Nos.4 to 13 not to interfere in the life and liberty of the petitioner.

In brief, the facts relevant to the present case are that the petitioner and one Manpreet Kaur, who is daughter of respondent Nos.4 and 5, were in love with each other and had run away and solemnized their marriage on 29.11.2019. Thereafter, the petitioner and Manpreet Kaur had approached this Court for grant of protection of their life and liberty by filing CRWP No.703 of 2020. On 22.01.2020, the said petition was disposed off and the petitioners therein were directed to approach the Senior Superintendent of Police, Hoshiarpur, District Hoshiarpur with a representation and the Senior Superintendent of Police, Hoshiarpur was

CRWP No.7817 of 2020 - 2 - directed to dispose off the same. The petitioner is stated to have gone abroad on 24.02.2020 and Manpreet Kaur went to live with her family. Thereafter, Manpreet Kaur stopped talking to the petitioner and on 18.09.2020, when the petitioner came back, the private respondents are stated to have come to his house and threatened the petitioner and his family members with dire consequences in case he tried to contact Manpreet Kaur. The petitioner has given a representation dated 19.09.2020 (Annexure P-3) to the Senior Superintendent of Police, Hoshiarpur apprehending danger to his life and liberty. However, no action has been taken.

Learned counsel for the petitioner would contend that though earlier the petitioner and his wife Manpreet Kaur had approached this Court for protection of their life and liberty and their petition was disposed off with a direction to the Senior Superintendent of Police, Hoshiarpur to decide their representation, however, now in the changed circumstances he is being compelled to approach this Court for protection of his life and liberty since the relatives of Manpreet Kaur have convinced her not to speak to petitioner and further they have been threatening the petitioner with dire consequences. Notice of motion.

On the asking of the Court, Mr. Ramandeep Sandhu, Senior Deputy Advocate General, Punjab has joined the session through video conferencing and accepts notice on behalf of respondent Nos.1 to 3. Heard the learned counsel for the parties.

In view of the facts narrated above, without expressing any opinion with regard to the veracity of the contents of the petition and the submissions made by learned counsel for the petitioner, the present petition is disposed off with a direction to the Senior Superintendent of Police Hoshiarpur (respondent No.2) to consider the representation dated

CRWP No.7817 of 2020 - 3 - 19.09.2020 (Annexure P-3) and take necessary action as per law. It is also made clear that this order shall have no effect, in any manner, on any other civil or criminal proceedings, if any, instituted/pending against the petitioner.
