Prayer in the instant petition filed under Section 482 Cr.P.C. is for issuance of a directions to respondents No. 2 and 3 to initiate date bound action in case FIR No. 33 dated 26.04.2023 (Annexure P-1) registered under Sections 363 and 366 IPC at Police Station Chabbewal, Hoshiarpur and complaints dated 27.04.2023 dated 03.05.2023 (Annexure P-3 and P-4, respectively) moved by the petitioner before respondents No. 2 and 3, qua kidnapping of his minor daughter, namely, Simranjit Kaur, by respondent No. 4 and 5.

Status report dated 16.06.2023, by way of affidavit of Sh. Daljit Singh, Deputy Superintendent of Police, Sub Division Garhshankar, District Hoshiarpur, on behalf of respondents No. 1 to 3 has already been filed.

Perusal of the status report would show that after registration of the aforesaid FIR, the police raided the house of respondent No. 4 in order to arrest him on 26.04.2023, but the house was RISHU KATARIA 2023.07.10 10:21 I attest to the accuracy and authenticity of this order/judgment

The police had issued Shoro Goga through CRO Branch to the Senior Superintendent of Police of all the Districts of Punjab for providing information about the minor daughter of the petitioner and also got published the news in Newspaper Prime Uday on 04.06.2023, in this regard. It has further been averred in the status report that the police had obtained call details of mobile No. 70104-69489 of respondent No. 4 and found that respondent No. 4 had contacted on mobile No. 9888038030 of Khushwant Singh, owner of P.G. before the occurrence. Thereafter, the police raided the P.G. accommodation. The owner of the P.G. stated that respondent No. 4 had contacted him on phone for hiring P.G. accommodation but did not turn up for staying. It has also been averred that the police is making sincere efforts to arrest respondents No. 4 and 5 and to trace out the daughter of the petitioner. 4.

Keeping in view the facts and circumstances of the case particularly the facts that FIR No. 33 dated 26.04.2023 (Annexure P-1) has been registered in April, 2023; and that the police is making sincere efforts to trace out the whereabouts of the minor daughter of the petitioner and the investigation is still going on, this Court is of the considered opinion that no further direction is required to be issued in the instant petition.

Accordingly, the instant petition stands dismissed being meritless.
