The petitioner prays for grant of regular bail pending trial in a criminal case arising from FIR No. 112 dated 12.05.2018, registered under Section 22 of the Narcotic Drugs & Psychotropic Substances Act, 1985 (hereinafter referred to as "the 1985 Act") at Police Station Sadar Khanna, Ludhiana.

The first petition for grant of regular bail was allowed on 08.10.2018, granting interim bail to the petitioner till the report from the Forensic Science Laboratory is received. The aforesaid report has been received.

As per the case of the prosecution, the petitioner was allegedly found in possession of 2500 intoxicating capsules. The average weight of each capsule is 636 mg. As per the trial Court, the total recovery would fall within the category of commercial quantity.

Criminal Misc. No. M- 28309 of 2019 Keeping in view the aforesaid facts, no ground is made out to grant the concession of regular bail to the petitioner. Hence, the present petition is dismissed.
