G.S.SANDHAWALIA, J. (Oral) The petitioner seeks the quashing of the letters dated 18.09.2014 (Annexure P-4) and 02.01.2015 (Annexure P-6) wherein, his request for compassionate appointment has been rejected on the ground that the government servant is still alive and that there is no provision in the Punjab Civil Service Rules to give jobs to the relatives during the lifetime of the employee who is mentally ill or retarded. The admitted case is that the petitioner's mother Raj Rani has not been paid the salary for the last more than 3 years. The State, in its affidavit filed today, has admitted that the admissible benefits will be released after following proper procedure in view of the provisions of Section 47 of the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995.

Counsel for the petitioner does not press his case regarding the relief of compassionate appointment and says that he would be satisfied if the salary is released to the mother of the petitioner at the earliest since the SHIVANI GUPTA 2016.01.

-2family is facing pecuniary difficulties in maintaining the government employee.

Resultantly, the present writ petition is disposed of with direction to the respondents that Raj Rani, Senior Assistant, widow of Iqbal Singh be paid her salary, which is due, within a period of one month alongwith interest @ 8% per annum. If the needful is not done within the said period, the said employee will be entitled for the interest @ 12% per annum, which will be recovered from the official found guilty of delay by the State.
