******* SURINDER GUPTA, J.(Oral) Learned counsel for the appellant submits that after filing of this appeal, claimants have entered into compromise with owner of the offending vehicle and the matter has been finally settled, as such, the instant appeal has been rendered infructuous and seeks permission to withdraw the appeal. He further submits that in view compromise, amount of `25,000/- deposited by the appellant may be refunded to appellant. Dismissed as withdrawn has having been rendered infructuous. Statutory amount of `25,000/- deposited by the appellant be refunded to him.
