MANJARI NEHRU KAUL, J. (ORAL) Petitioners are seeking the concession of anticipatory bail under Section 438 of the Cr.P.C. in case FIR No. 267 dated 21.05.2023 registered under Sections 420 and 506 of the Indian Penal Code, 1860 at Police Station Naraingarh, District Ambala.

Mr. Kuldeep Singh, Advocate, has entered appearance on behalf of the complainant and filed his power of attorney, which is taken on record.

Vide order dated 15.06.2023, the petitioners had been granted interim anticipatory bail with direction to join investigation and the relevant part of the said order reads as under:- "Learned counsel appearing on behalf of the petitioners inter alia contends that the petitioners were mediators in marriage between Satwinder Kaur and Philip. The allegations levelled by the complainant have no concern with the petitioners as no amount of any nature whatsoever had been given PUNEET SACHDEVA 2023.12.11 16:53 I attest to the accuracy and integrity of this document.

He further submits that the petitioners are not involved in any other criminal case and that they are ready and willing to join the investigation as and when so required. It is also contended that as no property is to be recovered from the petitioners, therefore, custodial interrogation is not required."

Learned counsel for the petitioners submits that in compliance of order dated 15.06.2023, the petitioners have joined investigation and cooperated with the investigating agency. Learned State counsel, on instructions, does not dispute the factum of the petitioners having joined investigation and cooperated with the investigating agency. She on further instructions submits that the petitioners are not required for further investigation much less for their custodial interrogation.

In view of the above, the petition is allowed and interim order dated 15.06.2023 is made absolute subject to the conditions laid down in Section 438(2) Cr.P.C.
