After hearing learned counsel for the applicants, instant application is allowed for the reasons stated therein, however, subject to all just exceptions and only for the purpose of decision of this appeal. Amended memo of parties is also permitted to be placed on record. CM stands disposed of.

Shivendra Swaroop, AAG, Haryana, accepts notice and after going through the record fairly states that the present appeal is covered by the order dated 23.12.2008 passed by this court in Suresh Kumar's case (supra).

In view of the above said undisputed fact situation obtaining in the present case, instant application is allowed as prayed for and the appeal is ordered to be disposed of in terms of the order dated 23.12.2008 passed by this court in RFA No.2936 of 2003 (State of Haryana and another Vs. Suresh Kumar and others).

Disposed of, accordingly.
