(ORAL) Challenge in the present petition is to order dated 02.02.2018 passed by learned Principal District Judge, Family Court, Gurugram, in CIS No. MNT-125/54/2015 titled as 'Anita vs. Ram Kumber Ram' whereby petition under Section 125 Cr.P.C. filed by the petitioner-wife has been dismissed on the ground that petitioner had failed to prove that she is legally wedded to the respondent or has any relationship in the nature of marriage with the respondent. Learned counsel for the respondent has pointed out that the respondent had filed a petition under Section 7(2) of the Hindu Marriage Act seeking annulment of marriage. Vide subsequent order dated 29.10.2018 passed by learned Principal Judge, South District Family Court, Saket, Delhi (Annexure R-1), the learned Family Court has found 'that the parties never entered into a valid marriage' and accordingly, DIVYANSHI 2024.07.26 10:50 I attest to the accuracy and integrity of this document

CRR(F)-241-2018 (O&M) -2 - the petition of the respondent under Section 7(2) of the Hindu Marriage Act was allowed. It is stated that in view of this fact, maintenance petition of the petitioner was correctly dismissed. The present revision petition pertains to the year 2018. Perusal of the order sheets shows that the matter was adjourned at request of learned counsel for the petitioner on 30.11.2018. There was no representation on behalf of the petitioner on 21.07.2022. Today also, none has appeared on behalf of the petitioner. Therefore, it can safely be presumed that the petitioner or her counsel is not interested in pursuing the present revision petition.

In view of the facts as submitted by learned counsel for the respondent, the present petition stands disposed of. In case anything survives in the present petition, liberty is granted to the petitioner to revive the same within a period of 4 weeks from today, if so advised.
