Lakhwinder Singh and others ............Petitioners vs The Vice Chancellor, Guru Nanak Dev University, Amritsar and another .............Respondents CORAM:- HON'BLE MR.JUSTICE JASWANT SINGH Present:- Mr.Shalender Mohan,Advocate for the petitioners Jaswant Singh,J(Oral) Services of seven petitioners were regularized in the years 2005/2007 by their employer, Guru Nanak Dev University,Amritsar(for short respondent University). They are stated to have initially been engaged on daily wage basis on Class IV posts in the years 1984/1985 and subsequently appointed on adhoc basis before their regularization by the respondent University.

Grievance of the petitioners is that new pension policy is being applied to them by assuming their date of induction as date of regularization by ignoring the previous service.

It is contended that case of the petitioners would be covered under the old pension policy by taking into consideration their previous engagement/appointment and the issue has been finally settled by a Division Bench of this Court in the case reported as Harbans Lal v State of Punjab and others, CWP 2371 of 2010 decided on 31.8.2010 (P-1). CWP 13988/2016 that in view of the settled law the petitioners would be governed under the old pension policy.

At the time of arguments learned counsel for the petitioners submits that his clients would be satisfied if their legal notice dated 29.5.2016 (P-2) addressed to the respondent University is directed to be disposed of in a time bound manner.

At the asking of the Court, Mr.Amrit Paul,Advocate, standing counsel for the respondent University accepts notice. Requisite copies of writ petition supplied to him. Mr.Paul has no objection if the present petition is disposed of with a direction to consider the claim of the petitioners as set out in the legal notice/writ petition within any reasonable time.

In view of the aforesaid stand present writ petition is disposed of with a direction to the competent authority of the respondent University to decide the claim of the petitioners as set out in the writ petition/legal notice within a period of four months by passing a speaking order in accordance with law. The period of four months would commence from date of receipt of certified copy of this order by the respondent University. Disposed of in the above terms.
