Petitioner has filed the present petition under Section 528 of the BNSS, 2023, seeking quashing of complaint No. NACT/2592/2025 (Annexure P-1), instituted by the respondent under Section 138 of the Negotiable Instruments Act, 1881 (for brevity, 'NI Act'), pending before the learned JMIC, Jalandhar, along with summoning order dated 18.03.2025 (Annexure P-4) and all consequential proceedings arising therefrom. 2.

A perusal of the case file reveals that although petitioner had made a statement on oath before the trial Court expressing readiness to make payment and to show his bona fides, only a photocopy of demand draft No. 834218 dated 14.01.2026 for an amount of Rs.56,022/-, drawn on Union Bank of India, was placed on record. However, from the zimni orders, there is nothing to indicate that the original demand draft was ever handed over or produced before the trial Court on 29.01.2026. 3.

It is further noticeable that none appeared on behalf of the petitioners on 19.05.2025, 07.08.2025, 29.11.2025, 05.03.2026 and even JAWALA RAM 2026.05.14 19:10 I attest to the accuracy and authenticity of this document

CRM-M-26475-2026 - 2 - before the Lok Adalat on 14.03.2026, 17.04.2026 and 12.05.2026. Prima facie, therefore, the statement made before the trial Court appears to have been made only to mislead the Court. Otherwise, petitioners could have moved an appropriate application for compounding of the offence or for placing the original demand draft on record and handing over the same to the complainant.
