This petition has been filed under Section 528 of BNSS (Section 482 Cr.P.C) for quashing of order dated 08.01.2026 passed by ld. Judge, Special Court, Hoshiarpur in case bearing NDPS-129 of 2021 (CNR No. PBH0010014852021) titled as "State of Punjab Vs Pargat Singh etc." pending for 01.06.2026 arising out FIR No. 265 dated 08.11.2020 under Sections 18(b)/29/61/85 of NDPS Act registered at Police Station Dasuya District Hoshiarpur vide which bail order of the petitioner has been cancelled and bail bonds and surety bonds have been forfeited and non bailable warrants of arrest have been issued against the petitioner.

Learned counsel for the petitioner submits that the petitioner could not appear before the learned trial Court due to some unavoidable circumstances . Consequently, the learned trial Court cancelled the bail orders of the petitioner and his bail bonds and surety bonds were ordered to be forfeited to the State and petitioner was ordered to be summoned through nonRENU RAWAT 2026.05.12 16:38 I attest to the accuracy and integrity of this document
CRM-M-26451-2026 bailable warrants of arrest. He further prays that the petitioner is ready and willing to join the proceedings before the Court and the impugned order dated 08.01.2026 be set aside.

On the asking of Court, Mr. P.S.Pandher, Asstt.AG Punjab accepts notice on behalf of the respondent-State. 5.
I have heard learned counsel for the parties and gone through the case file.

In view of the limited prayer made by the learned counsel for the petitioner, this Court does not find any legitimate ground to interfere in the impugned order dated 08.01.2026 passed by ld. Judge, Special Court, Hoshiarpur. However, in case the petitioner surrenders before the trial Court within a period of 07 days from today and moves an application for grant of regular bail, the trial Court is directed to consider and decide the same within a period of 03 days.
