Heard. It appears that the wife of the petitioner had filed an application for partition of joint land against Jai Ram which was allowed. Appeal against order dated 5.8.2011 passed by the Assistant Collector First Grade, Balachaur, in partition proceedings had been dismissed by Collector, Mohali on 21.7.2015. Statutory revision appears to have been filed by Jai Ram against the order dated 21.7.2015. The documents produced by way of misc. application reflect that during pendency of the appeal of Jai Ram, further proceedings for possession/ dispossession have been stayed. CWP-10445-2017 (O&M) The petitioner through the instant writ petition seeks a direction to the Deputy Commissioner, District Saheed Bhagat Singh Nagar, to vacate the stay.

Counsel for the petitioner submits that only prayer of the petitioner is that a direction should be issued for consideration of the application for vacation of stay.

After hearing the counsel for the petitioner, it appears that appropriate application before the revisional Court, for vacation of the stay has not been filed.

This petition is disposed of as not maintainable with liberty to the petitioner to approach the revisional Court for expeditious disposal of the revision/ vacation of the stay. In case any such application is filed, it is expected that the same will be taken up expeditiously in accordance with procedure of law.
