The petitioner through instant petition under Article 226/227 of the Constitution of India is seeking direction to respondent to adjudicate show cause notice dated 02.07.2025 (Annexure P-19). It is further seeking direction to respondent not to take any coercive steps including stoppage of referrals. It is also seeking direction to respondent to consider it for fresh empanelment.

This is third round of litigation. The petitioner-hospital vide memorandum dated 05.03.2020 was empanelled under Ex-Servicemen Contributory Health Scheme (for short 'ECHS'). The respondent vide order dated 10.09.2020 on the basis of complaints stopped referrals to the petitioner-hospital. It vide orders dated 18.06.2021 and 23.06.2021 was de-empanelled. It on earlier occasions approached this Court by way of DEEPAK BISSYAN 2026.05.13 16:59 I attest to the accuracy and authenticity of this order/judgment

CWP-14786-2026 -2CWP-12301-2021 and CWP-27354-2022 which were disposed of vide orders dated 13.10.2021 and 04.03.2025 respectively with the direction to respondent-authorities to proceed with show cause notice in accordance with law and prescribed procedure. It was again issued show cause notice dated 02.07.2025. It filed reply dated 04.08.2025. The proceedings are pending since 2020 and all the referrals for treatment under the Scheme have been put on hold since September' 2020. The respondent without any reason is sitting over the matter.

Learned counsel for the respondent submits that competent authority would look into the matter and adjudicate show cause notice in due process.

Considering the fact that show cause notice was issued on 02.07.2025 and reply was filed on 04.08.2025, this Court finds it appropriate to direct respondents to adjudicate aforesaid show cause notice within two months from today. The petitioner shall be granted opportunity of hearing before passing the order. 5.
