Mr. Munish Bhardwaj, Advocate for the complainant. PANKAJ JAIN, J. (ORAL) This petition has been filed under Section 439 Cr.P.C0. for grant of regular bail to the petitioner in case F.I.R. No.195 dated 12.09.2019 registered for the offences punishable under Sections 406, 420 IPC and Section 13 of the Punjab Travel Professional (Regulation) Act, 2014 at Police Station Phase-I, SAS Nagar, District Mohali. Custody Certificate of the petitioner has been filed today in Court, which is taken on record.

Counsel for the petitioner at the outset submits that the petitioner is ready to deposit an amount of Rs.7.00 lacs to show her bona fide and will have no objection if the same is released to the complainant subject to furnishing of indemnity bond and the same will be further subject to the satisfaction of the Trial Court. It has been further submitted that the petitioner is behind bars since 06.05.2023. Per contra, Mr. Bhardwaj has very eloquently opposed the bail claiming that the petitioner has duped number of persons. However it is not in dispute that the investigation has been concluded and the challan stands presented.

In view of the aforesaid fact and keeping in view the incarceration suffered by the petitioner and the stand taken by her to show her bona fide, the present petition is allowed. The petitioner is ordered to be released on bail to the satisfaction of Trial Court/Duty Magistrate concerned subject to petitioner's abiding by the undertaking given by her counsel w.r.t. deposit of Rs.7.00 lacs in the Trial Court. Needless to say after the deposit of the aforesaid amount, in case the complainant moves an application and furnishes security to the satisfaction of the Court concerned the amount be released to the complainant.
