The present petition has been filed by the borrower assailing the proceedings commenced by issuing show cause notice by the District Magistrate under Section 14 of the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (for short 'SARFAESI Act'), after pursuing the process under Section 13 (2) of the SARFAESI Act.

The petitioner has not availed the alternative statutory remedy under Section 17 of SARFAESI Act before the Debt Recovery Tribunal and thereafter under Section 18 before the Debt Recovery Appellate Tribunal.
