(ORAL) Petitioner herein is one of the plaintiffs of the Civil Suit bearing No.CS-2225-2021 title Daljit Kaur and another Vs. Nirmal Kaur and others, pending before learned Civil Judge (Junior Division), Jalandhar. She is aggrieved by the order dated 17.04.2026 (Annexure P-6), whereby application of the defendants i.e. respondents herein for additional evidence has been allowed. 2.
Perusal of the impugned order would reveal that in additional evidence, the defendants sought to place on record a judicial order dated 30.08.2019 passed in the execution proceedings of the suit property. It has been rightly noticed by the trial Court that proposed additional evidence is a judicial order. Even otherwise, the judicial notice thereof could have been taken by the trial Court. Therefore, no illegality or perversity can be found in permitting the defendants to produce the additional evidence so as to place on record the aforesaid order dated 30.08.2019. However, it is made clear that relevancy of the said order to the proceedings of the present case shall be subject to the adjudication by the trial Court at the appropriate stage. It is also made clear that petitioner-plaintiff will also be granted liberty to rebut the additional evidence of the respondents-defendants. 3.
