IN THE HIGH COURT OF PUNJAB & HARYANA
AT CHANDIGARH Date of decision:23/07/2016.
Ravinder Vashisht,DPE ............Petitioner vs State of Punjab and others .............Respondent CORAM:- HON'BLE MR.JUSTICE JASWANT SINGH Present:- Mr.Ashok Giri,Advocate for the petitioner.
Jaswant Singh,J(Oral) Petitioner is working as Demonstrator of Physical Education (D.P.E.) with Secondary Education Department,Punjab. He has laid challenge to the order dated 6.6.2016(P-6) whereby he was transferred from Government High School, Majat,Mohali to Government Senior Secondary School, Amlala, Mohali; further challenge is to the order dated 28.6.2016 whereby P-6 was modified and he was then transferred to Government Senior Secondary School, Amrala, Fatehgarh Sahib. Counsel for the petitioner heard.
Without going into the relative merits of the recommendations of the Panchayat qua his transfer, it cannot be disputed that transfer is an incidence of service and the post held by the petitioner belongs to State Cadre. As per statutory rules the petitioner can be posted anywhere throughout the State. Petitioner is a permanent resident of Mohali and has been transferred from one direction to the other. It is well settled that no employee has a vested right to remain posted at one place. Dismissed.
