The instant petition has been filed under Section 438 Cr.P.C for grant of anticipatory bail to the petitioner in case FIR No.31 dated 27.05.2023 registered under Section 498 A IPC (Section 406 IPC added later on) at Police Station Women, District Amritsar Commissionerate.

Learned counsel for the petitioner

 contends that the FIR was registered at the instance of the respondent No.2 complainant with the allegations that the petitioner had harassed respondent No.2 complainant on account on demand of dowry.

On 14.06.2023, the Coordinate Bench of this Court passed the following order:

On asking of the Court, Mr. Kirat Singh Sidhu, Deputy Advocate General, Punjab, accepts notice on behalf of respondent No. 1 and seeks time to have instructions or file response in the matter.

Requisite copies of paper book be supplied to learned State Counsel during the course of day.

In the meanwhile, petitioner shall join investigation POONAM BHATT 2024.01.30 00:01 I attest the accuracy and authenticity of this order/judgment




   


before the Investigating Officer. In the event of his arrest, the Arresting Officer would admit him to interim bail, till the next date of hearing, on furnishing adequate bail and surety bonds to his satisfaction. The petitioner shall also abide by all the conditions as envisaged under Section 438(2) of Code of Criminal Procedure, 1973."

Learned counsel for the petitioner further contends that the petitioner had joined the investigation in compliance of the order dated 14.06.2023 passed by the Coordinate Bench of this Court.

Learned counsel appearing on behalf of the respondent State on instructions from ASI Avtar Singh confirms that the petitioner has joined investigation and also contends that his custodial interrogation is not required. 6.

The counsel appearing on behalf of the respondent No.2 complainant does not raise any objections in case the present petition is allowed. 7.

In view of the reasons recorded in the order dated 14.06.2023 and keeping in view the fact that the petitioner has joined investigation, his custodial interrogation is not required by the Investigating Agency, the present petition is allowed and the order dated 14.06.2023 granting interim bail to the petitioner is made absolute, subject to the conditions laid down in Section 438(2) Cr.P.C. 3 0 1
